Penalty Unit Increase

On 1 December 2008, the Penalties and Sentences and Other Acts Amendment Act 2008 (Qld) was assented to amend the Penalties and Sentences Act 1992 (Qld) to increase penalty units in Queensland all offences (other than offences under local laws).

Examples of the effect of the increase in the value of a penalty unit are set out below.

Old Maximum Fine for Companies

New Maximum Fine for Companies

o    Wilfully and unlawfully causing serious environmental harm – $1,561,875

o    Unlawfully causing serious environmental harm – $624,375

o    Wilfully and unlawfully causing material environmental harm – $624,375

o    Unlawfully causing material environmental harm – $313,125

o    Wilfully and unlawfully causing environmental nuisance – $313,125

o    Unlawfully causing environmental Nuisance – $61,875

o    Wilfully and unlawfully causing serious environmental harm – $2,082,500

o    Unlawfully causing serious environmental harm – $832,500

o    Wilfully and unlawfully causing material environmental harm – $832,500

o    Unlawfully causing material environmental harm – $417,500

o    Wilfully and unlawfully causing environmental nuisance – $417,500

o    Unlawfully causing environmental Nuisance – $82,500
